2. Cookies and Similar Technologies

Our platform uses Cookies and Similar Technologies insofar as this is technically absolutely necessary for the use of the platform or you have declared your consent to this. Cookies are small text files that are stored on your end device with the help of the browser. Similar Technologies are all other applications that store information on your end device or access such information. For easier understanding, the term "Cookies" will be used in the following for all applications concerned.

2.1. We use also Cookies to make the platform user-friendly and needs-orientated and to gather information for a better user support. In addition we use Cookies to gather data for marketing purposes. A better trained AI will provide you with a better user experience and better suggestions for users with common interests. Some Cookies remain stored on your terminal device until you delete them. They enable us to recognize your browser the next time you visit the platform. Function and Purpose of Cookies

Your name, e-mail address or similar data that would enable the Cookie to be assigned to you are not stored in the Cookie.

2.3. Storage Period

Regarding the storage period, a distinction must be made between "Session Cookies" and "Persistent Cookies":

Session Cookies are automatically deleted when you leave our platform. Persistent Cookies, on the other hand, remain on your end device until the Cookies either reach an expiry date set by us or are manually deleted by you in your browser. The exact storage period can be found under point 3.

3. Legal Basis for the Use of Cookies

There are Cookies that require your consent prior their activation and Cookies that can be used without your consent because they are technically necessary to provide our platform ("Strictly Necessary Cookies").

3.1. Strictly Necessary Cookies

In the case of Strictly Necessary Cookies, the data processing is necessary for the purpose of data security measures, to prevent misuse and to ensure functionality and is therefore based on our legitimate interests pursuant to Art 6 Para 1 lit f GDPR in conjunction with Sec 165 Para 3 TKG. These Cookies are necessary for the platform to function and cannot be deactivated on the platform. You can set your browser to block these Cookies or to notify you of these Cookies. However, some areas of the platform will then not function completely.

AWS Amplify Analytics, powered by Amazon Pinpoint, enables the collection of various user engagement metrics and behaviors in your Flutter mobile app. Below is a table summarizing the key data points you might track, emphasizing the purpose, type of data, and compliance notes.

3.2.1. Admob

With your freely-given consent according to Art 6 (1) (a) GDPR, we use the tool AdMob, an analysis and targeted advertising service for ad performance metrics provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, California, 94043, USA ("Google").

The information generated by these Cookies, such as the performance of personalized and non-personalized advertisements, is transferred to a server in the USA and stored there. This transfer is also based on your freely-given consent.

Google will use the information generated by Cookies on behalf of GamerTag to analyze your interaction with advertisements visible on the platform and to compile respective reports and metrics. In the case you have also provided your consent to behavioral advertising (Pt 2.1.7 of the GamerTag Privacy Policy), the service will also provide and assess the performance of personalized commercial offers.

Processing also takes place outside the European Union (EU) or the European Economic Area (EEA), namely in the USA. The EU Commission has issued an adequacy decision for the USA. The data recipient is self-certified and listed in the Data Privacy Framework list (https://www.dataprivacyframework.gov/list).

4. Cookie Management

You can adjust the cookie settings at any time. Simply open the cookie consent tool [“in the upper right corner of the Gamer Passport” in the section “cookie settings”.]

5. Data Subject Rights

You have the right to access your personal data, right to rectification, erasure, restriction of processing and data portability. If the processing is based on your consent, you can withdraw it at any time with the effect for the future, e.g. by e-mail to support@gamertag.app. In addition, you can object to data processing if it is based on our legitimate interests on grounds relating to your particular situation. In this case will no longer process your personal data unless we can demonstrate compelling legitimate grounds. This grounds must override your interests and rights or the processing is necessary for the establishment, exercise or defense of our legal rights.

If you feel that the processing of your data is unlawful or that your data subject rights are infringed in any other manner, you are entitled to file a complaint at the Data Protection Authority.
